1) DEFINITIONS

For these General Conditions of Rental, the following terms are defined:

• Company and/or Lessor: the company Noleggio Barche Lucibello s.r.l., VAT No. 03042910657, located in Positano (SA), at Via del Brigantino no. 9, in p.l.r.p.t.;
• Customer and/or Lessee: the individual and/or legal entity that has rented the Company’s boat via the website or at designated premises and/or authorized agencies;
• Boat and/or Pleasure Craft: the boat and/or pleasure craft that is part of the fleet of Noleggio Barche Lucibello s.r.l.

2) SERVICE DESCRIPTION AND TERMS

The Company guarantees the Boat Rental service for private tours with and without a skipper in compliance with the following General Conditions of Rental, available on the website www.lucibello.it and subject to the relevant rental contract to be signed at the Company’s gazebo stations. Noleggio Barche Lucibello reserves the right to adopt or modify these General Conditions of Rental at any time. In case of modifications, the General Conditions of Rental in effect on the booking date will apply to each reservation. The Services offered by the Company are as follows:

A. PRIVATE AND/OR GROUP TOURS WITH A PRIVATE DRIVER

The Company organizes and offers private and/or group tours with a driver, with conditions related to the number of people, place, date, duration of the route, starting point, and boat already predetermined. In such cases, the Customer can book the pre-organized tours listed on the website, subject to availability.

B. BOAT RENTAL WITHOUT A DRIVER

The Company offers the service of renting boats without a driver. At the time of booking, if necessary, the Manager may request the presentation of a boating license if required by law. The Customer is obliged to comply with the provisions in these general regulations, the rental contract to be signed between the parties, and to adhere to the instructions of the Company and its staff and the prevailing laws. The Company reserves the right to expand its range of Services at any time.

3) BOOKING PROCEDURES

Customers who are 18 years or older can book and purchase products available in the electronic catalog on www.lucibello.it. The booking can be made through the website www.lucibello.it. The customer must provide all the required information in the booking form.

Booking the Rental Service online on the website www.lucibello.it constitutes an explicit acknowledgment, understanding, and acceptance of these terms and conditions. An online booking, i.e., through computer procedures made available by the Company on the Internet site, when completed with the full or partial payment of the rental fee requested by the Company, constitutes an additional explicit acknowledgment by the Customer of full acceptance of the General Rental Conditions.

Once the order is placed, a confirmation email will be sent to the email address provided by the Customer. The confirmation email will contain an “Order Number” to be used in any further communication with www.lucibello.it. The email contains all the data entered by the Customer, who must verify its correctness and promptly report any corrections according to the methods described in this document.

4) PAYMENT AND FEES

The fee for each Rental Service varies depending on the type of tour requested. In any case, the price of each tour is indicated directly in the explanatory sheet dedicated to it and present on the Website.

The purchase procedure is indicated on the Website. To conclude the contract, the Customer must fill out the Booking Form in electronic format and transmit it to the Company electronically, following the relevant instructions.

The Booking Form contains a reference to these General Conditions, summarizing the essential information about each Service ordered and the relative price (including all applicable taxes and duties), the payment methods, and the service delivery methods.

The booking of the Service is considered completed when the Customer clicks the confirmation button.

All prices on the website www.lucibello.it include VAT unless otherwise indicated. The Company reserves the right to change prices at any time without notice.

The Customer can make the service booking using Mastercard, Visa, Postepay, American Express, Discover, and Diners Club credit cards, as well as all major credit and prepaid cards. The agreed amount for the fee will be paid at the time of booking via electronic payment.

5) INVOICE AND/OR RECEIPT

For every order placed on www.lucibello.it, an invoice and/or receipt will be issued following Article 14 of the D.P.R. 445/2000 and D.L. 52/2004 and will be sent to the purchaser along with the products. The data provided by the Customer will be used for issuing the invoice. Noleggio Barche Lucibello reminds the customer to always verify the accuracy of the provided information with utmost attention. No changes to the invoice will be possible after issuance.

6) SECURITY

The User’s card data used for booking is processed through the SSL security system. At the time of order completion, the 3DS authentication procedure will be used, and the User will be redirected to their bank’s web page. To complete the order, simply follow the required steps.

7) GUARANTEES

The Company guarantees to have all necessary authorizations and licenses for performing the Services. The Company also guarantees to have the competence and experience in the sector and to provide the Services using adequately controlled and suitable Boats. The Company undertakes to provide the Customer with a Service that matches the description on the Website, in the explanatory sheet of the tour, or any other information or description from the Company itself.

8) CUSTOMER RESPONSABILITY

The customer is responsible for the boat and its equipment during the rental period. Any damage caused by improper use will be charged to the customer. For private tours without a skipper, the boat must be used exclusively for the booked private tour. It is forbidden to use the boat for illegal activities or to carry a number of passengers exceeding the allowed limit.

9) DISCLAIMER OF LIABILITY

Noleggio Barche Lucibello s.r.l. is not responsible for any errors or omissions, technical inaccuracies, or typographical errors on the site or for interruptions in web services. Additionally, it will not be responsible for indirect, incidental, or consequential damages arising from the use of the boat.

10) BREACH AND EXPRESS TERMINATION CLAUSE, WITHDRAWAL

The User’s breach of the obligations provided in these General Conditions of Contract and the Rental Agreement stipulated between the parties will result in the immediate termination of the agreement, and all amounts paid in advance to the Company will be retained as a penalty, without prejudice to further damages.

The Customer has the right to withdraw from the contract up to 20 days before the Rental Service. The Company will retain 30% of the amount paid as a penalty deposit and/or penalty.

If the Customer withdraws from the twentieth day to the day of the service, the amounts paid will be retained by the Company as a penalty deposit and/or penalty. In the event of adverse weather/marine conditions and/or orders from maritime authorities, no penalty will be applied, and a 100% refund will be processed. The company may cancel and/or reschedule the service with a similar boat for technical reasons or because of availability changes.

11) APPLICABLE LAW AND JURISDICTION

This Contract is governed by Italian law and is interpreted under it. For any disputes that may arise concerning the interpretation, execution, resolution of this contract, or in any way connected to it, the Court of Salerno shall have exclusive jurisdiction.
